Case Details: This petition challenges The Allahabad Hight Court order whereby Through the previous order of this case, several bail applications for bail.
However, the present bail application is rejected by The Honorable High Court, accordingly. Considering the entire facts and circumstances of the case, submissions of learned counsel for the parties, nature of evidence, gravity of offence and all attending facts and circumstances of the case, without expressing any opinion on merits of the case, the Court is of the view that the no case for bail is made out.
Facts: The applicant, Sameer Alias Sanam, is accused of abducting a minor girl. The prosecutrix is identified as being underage at the time of the alleged incident, with her age verified as 17 years and 8 months based on her High School certificate. The applicant claims he has been falsely implicated due to enmity with the victim’s family. There are no independent witnesses to corroborate the incident. The applicant has been in jail since April 10, 2024, and has no prior criminal record. These facts led to the legal proceedings against the applicant, culminating in the bail application being considered by the court.
Held by Court: The Apex court, presided over by Hon’ble Justices B.R. Gavai and Aravind Kumar, ordered the issuance of a notice to the respondents, returnable in four weeks. Additionally, the petitioner was granted the liberty to serve the notice through the Standing Counsel for the respondent/State. This approach allows for efficient communication and ensures that the respondents are made aware of the proceedings in a timely manner.
