The application is filed under sec 438 of Cr.P.C, praying for the grant of pre arrest bail to the accused. The petitioner has not committed any offence. the petitioner contends that on the day of the incident, he observed the informant’s grandson lying on the road. Petitioner helped him but mistakenly he was identified as an accused by the informant.
Facts: –
The petitioner, therefore, prays for the grant of interim pre-arrest bail and submits that he is ready to cooperate with the investigation. One chance may be given to the accused/petitioner to record his statement and to co-operate in the investigation
Court Observed:
Court finds it a fit case to grant the privilege of interim pre-arrest bail to the accused/petitioner Held by Court: – Indian Penal Code, he shall be enlarged on interim pre-arrest bail on his executing a bond of Rs. 20,000.
The petitioner shall make himself available for interrogation by the Investigating Officer within 7(seven) days. The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. Thhe petitioner shall not leave the jurisdiction of the concerned jurisdictional Magistrate, without prior permission. The matter is listed again on 12.09.2024.
