Appellate tribunal NCLAT has upheld an order to allow the central government to take over the management of Delhi Gymkhana Club.
The National Company Law Appellate Tribunal (NCLAT) set aside the petition filed by the management members against the order passed by the Principal Bench of the NCLT.
On April 1, 2024, the NCLT allowed the plea filed by the Ministry of Corporate Affairs for taking over the Delhi Gymkhana Club management citing that it is violating the provisions of the Company Law and said there was “sufficient material” and state that it is a case of mismanagement.
Quorum comprising chairperson Justice (retd) Ashok Bhushan and technical member in its 149 page judgment upheld the order allowing the Center government to take over the management of Gymkhana Club and directed the Center to nominate 15 members committee to conduct elections at the post of President and general council of the Gymkhana Club by June 2025 and to manage affairs of the club.
Moreover, the NCLT has directed the ministry to carry out all directive measures by March 31, 2025.
