VIOLATION OF ARTICLE 21 DUE TO STUBBLE BURNING 

Supreme Court on October 24 emphasized that stubble burning not only violates personal law but also violates fundamental right of the citizen under Article 21 of Indian Constitution. 

A bench of Justice Abhay Oka and Justice Ahsanuddin  and Justice Augustine George Masih was hearing the petition filed by MC Mehta case today concerning the Air Pollution repeatedly increasing in National Capital because of stubble burning in Punjab and Haryana. 

Bench chastise both the state governments on failure to maintain the pollution levels. CAQM asked to take legal actions against violaters. Moreover, the Court last week summoned both the secretaries of Punjab and Haryana. Furthermore, Air Quality Index in National capital has surpassed 350- mark for the first time indicated (very poor). 

Bench also brought up regarding the Center bringing Environment Pollution laws as “ Toothless” and also told that provision under CAQM is not being implemented properly.  However, Haryana government has already suspended 24 officials failing to prevent stubble burning.
